Affiliate Program Terms & Guidelines

Effective Date: June 20th, 2026.  By signing up to our affiliate program, you agree to the following terms:

Disclosures & Policies

Our goal is to spread the word regarding our high quality American made offerings in a manner that informs consumers accurately, and abides by government and marketplace regulations.  

    • You must follow all FTC rules regarding affiliate disclosure.
    • Do not make false, exaggerated, or unsubstantiated claims about our products.
    • Affiliates promoting our products on Amazon or other third-party marketplaces must comply with all applicable marketplace rules, policies, and terms of service.
    • Avoid review manipulation (offering compensation or incentives for reviews, or requesting “positive reviews”, etc.).

    • Avoid using trademarked or copyrighted marketplace images, content, or symbols.

      Affiliate Pay

      Affiliate sales will be tracked using attribution links.  Commissions will be based on net sales credited to each attribution link after any returns, refunds, or chargebacks. Commission rates are subject to change. We will provide advance notice of any changes to active affiliates.

      We reserve the right to withhold payment for up to 180 days if we have reason to believe fraud has occurred, we anticipate additional returns, we anticipate additional chargebacks, or if we have any reason to doubt the legitimacy of any sales.

      We reserve the right to deny commissions resulting from fraud, self-purchases, automated traffic, misleading advertising, coupon abuse, cookie stuffing, attribution manipulation, or any other activity we determine to be invalid or abusive.

      We are not responsible for the accuracy of sales attribution or tracking issues outside of our control.  We reserve the right to determine, in our sole discretion, whether a sale qualifies for commission credit.

      Once affiliate pay reaches a certain threshold within a calendar year, we will request tax information from you.  Continued payment of commissions will require this tax information.  You are responsible for taxes on your earnings.

      Our Relationship

      We value our affiliates and are committed to building a mutually beneficial, respectful, and straightforward partnership. To support this:

      • All private communications, commission rates, sales data, performance reports, and other confidential or proprietary information shared between us must remain strictly confidential. You agree not to disclose this information to any third party without our prior written consent.
      • We both agree to act in good faith and communicate openly and professionally.
      • Affiliates are independent contractors and are not employees, agents, partners, franchisees, or representatives of Hungry Santa Trading Company. Affiliates have no authority to bind or act on behalf of the company.

      Either party may terminate the affiliate relationship at any time, for any reason, with or without notice.  Upon termination, any valid earned commissions accrued prior to termination will remain payable according to these terms. Commissions associated with fraudulent, invalid, or disputed transactions may be withheld or forfeited.

      Legal Information

      • You may use our approved logos, images, and branding materials solely to promote our products. You may not modify them or use them for any other purpose without written permission.  
      • We retain all rights, title, and interest in our trademarks, logos, product images, content, and other intellectual property. Participation in the affiliate program does not grant ownership rights in any of our intellectual property.
      • We reserve the right to reject, suspend, or terminate any affiliate application or participation at our sole discretion.
      • All rights granted under these terms automatically terminate when the affiliate relationship ends.

      Limitation of Liability

      • To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the program. Our total liability to you will not exceed the total amount of unpaid commissions owed to you at the time of the claim.

      Indemnification

      • You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and expenses (including reasonable attorney fees) resulting from your content, websites, links, advertising, or actions as an affiliate, including any violation of laws or third-party rights.

      General Disclaimers

      • The program and all materials are provided “as is” without any warranties. We make no guarantees regarding sales volume, commission amounts, conversion rates, or product performance.

      Changes to Terms

      • We may update these terms at any time. We will notify active affiliates of material changes. Your continued participation after notification constitutes acceptance of the updated terms.

      Governing Law

      • These terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes will be resolved exclusively in the courts located in Denton County, Texas.
